§ 13.5. Public hearing—Notice.

  • A public hearing for the hearing of objections to the making of any public improvement shall be held at the meeting at which the Council shall receive the report of the City Manager on such improvement or at any regular meeting of the Council subsequent thereto. The date of such meeting to be determined by the Council not less than 14 days prior to the holding thereof. Notice of such meeting shall be given by the Clerk to each property owner of record by registered mail, return receipt requested, addressed to the last known address of such property owners according to the last assessment roll of the city and the records of the Register of Deeds of the County of Alpena, mailed not less than ten (10) days prior to the date of the holding of such meeting. Failure of any property owner whose ownership is not indicated by the last previous assessment roll of the city or the records of the Register of Deeds of the County of Alpena to receive the notice heretofore provided, or in any case of failure to receive the notice herein provided, where there has been no wilful negligence, fraud, or attempt to deceive, shall not invalidate the proceedings authorized to be taken under this chapter. In all cases where property is owned jointly by husband and wife, notice to either shall be sufficient.
