§ 13.7. Determination by the council.

  • At such meeting, following the hearing herein provided, or at any regular meeting of the Council held within thirty (30) days thereafter, the Council shall determine by resolution whether or not to proceed with the public improvement proposed or for which the petition was filed or may modify the scope thereof in such manner as the Council shall deem to be in the best interest of the city as a whole. If the determination of the Council shall be to proceed with the improvement, the resolution shall set forth the nature of the improvement, designate the limits of the special assessment district to be affected, prescribe what part or proportion of the cost of such improvement shall be paid by special assessment upon the property benefited, and what part, if any, shall be paid by the city at large, specify the manner and method of paying for or financing the same in each case, and determine whether the cost of the improvement shall be spread upon a special assessment roll before or after the improvement has been completed.
