§ 18-1. Moratorium on issuance of permits or licenses for sale or dispensation of medical marihuana within the city.

  • (a)

    Findings. The municipal council has determined that:

    (1)

    The provisions within the city zoning ordinance were adopted on January 18, 2010 and that these zoning regulations have not kept pace with recent statewide legislation.

    (2)

    It is within the rights of the city to establish reasonable regulations to control the sale and dispensation of medical marihuana in order to protect the public health, safety and welfare.

    (3)

    A moratorium should be imposed upon the issuance of any and all permits or licenses for the sale or dispensation of medical marihuana for six (6) months or until an amendment of the zoning ordinance and other applicable codes, whichever occurs first.

    (b)

    Moratorium. That there be and hereby is imposed for a period of six (6) months from the effective date of the ordinance from which this section derives a moratorium upon the issuance of any and all permits or licenses for the sale or dispensation of medical marihuana within the city.

    (c)

    Expiration. The moratorium imposed by this section shall expire the earlier of six (6) months from its effective date or the effective date of an amendment to the zoning ordinance and/or other applicable codes as deemed necessary.

    (d)

    Compassion clubs and smoke houses. The moratorium imposed by this section shall also apply to any facility used as or commonly referred to as a "compassion club" and/or "smoke house."
