§ 34-32. Definitions.

  • The following words, terms and phrases when used in this article, shall have the meanings ascribed to them in this section, except where the context clearly indicates a different meaning:

    Hazardous materials means, but is not limited to, a chemical that is a combustible liquid, a flammable gas, explosive, an organic peroxide, an oxidizer, pyrophoric, unstable reactive or water reactive, radioactive materials, petroleum or petroleum products or gases, poisons, etiologic (biologic) agents, flammables or corrosives, and any other substances or materials which is a threat to the public health, safety, or welfare.

    Release means any spilling, leaking, pumping, pouring, emptying, discharging, injecting, leaching, dumping or disposing, or otherwise allowing hazardous materials or substances to escape containment.

    Responsible party means any individual, firm, corporation, association, partnership, commercial entity, consortium, joint venture, government entity or any other legal entity that is responsible for a release of a hazardous material, either actual or threatened, or is an owner, tenant, occupant or party in control of property onto which or from which hazardous materials release.
