§ 54-9. Regulation of skateboards and rollerblades and all similar skateboard and roller devices.

  • (a)

    Use of skateboards prohibited in downtown development authority district area south of Thunder Bay River. No person shall use or ride upon a skateboard or similar skateboard device anywhere within the downtown development authority district area as described in section 10.5-31 of this Code, lying south of Thunder Bay River. Skateboards may, however, be used on that portion of the bike path located within this area, which bike path includes the sidewalk on the northeast side of Water Street from Second Avenue to Harbor Drive and the sidewalk on the southeast (lake) side of Harbor Drive to Prentiss Street. Use of skateboards shall also be allowed in this area on the sidewalk located on the northwest side of Second Avenue from the Second Avenue Bridge to Carter Street.

    (b)

    Use of skateboards outside of downtown development authority district area. Skateboards and similar skateboard devices may be used upon any public sidewalk outside the downtown development authority district area, and on any property owned by another only if the owner, lessee or occupant of that property posts same with a sign allowing the use of skateboards or similar skateboard devices on same or with explicit permission of property owner, lessee or occupant of the involved property.

    (c)

    Use of rollerblades. Rollerblades and similar roller devices may be used upon any public sidewalk. These devices may also be used upon any property owned by another only if the owner, lessee, or occupant of that property posts same with a sign allowing the use of rollerblades or similar roller devices on same or with explicit permission of property owner, lessee or occupant of the involved property.

    (d)

    Use of skateboards and rollerblades prohibited on city streets and alleys. No person shall use or ride upon a skateboard or similar skateboard device or rollerblade or similar roller device, on any public street or alley located within the downtown development district area, or outside the downtown development authority district area except where no sidewalk or portion of bike path exists adjacent to a street, in which case the skateboard or rollerblades shall be used or ridden as close as possible to the curb or edge of the paved portion of the street. Skateboards or rollerblades may be used or ridden upon, however, on crosswalks, when crossing streets or alleys at intersections.

    (e)

    Penalty. Any person violating the provisions of this section is responsible for a civil infraction and shall be assessed a civil fine not to exceed $50.00.
