§ 6-31. Definitions.

  • The following words and phrases, when used in this article, shall, for the purpose of this article, have the meanings respectively ascribed to then below, except in those instances where the context clearly indicates a different meaning:

    Cabaret means any place wherein food or any type of alcoholic beverage is sold or given away on the premises and the operator, manager or owner thereof holds a license issued by the liquor control commission of the state to sell or serve such beverages by the glass.

    Specified anatomical areas means:

    (1)

    Less than completely and opaquely covered:

    a.

    Human genitals;

    b.

    Pubic region;

    c.

    Buttocks;

    d.

    Female breast below a point immediately above the top of the areola.

    (2)

    Human male genitals in a discernible turgid state even if completely or opaquely covered.

    Specified sexual activities means:

    (1)

    Human genitals in a state of sexual stimulation or arousal;

    (2)

    Acts of or simulated acts of human masturbation, sexual intercourse, sodomy, bestiality, fellatio or cunnilingus; and

    (3)

    Fondling or other erotic touching of human genitals, pubic region, buttocks or female breast.
