§ 98-241. Emergency suspension of service and discharge permits or waivers.

  • The city may, for good cause shown, suspend the wastewater treatment service, the water supply service, and/or the wastewater discharge permit or waiver of a discharger when it appears to the city that an actual or threatened discharge presents or threatens: a violation of the NPDES permit; an imminent or substantial danger to the health or welfare of persons; an adverse impact to the environment; interference with the operation of the POTW; violation of any pretreatment limits imposed by this division or violation of any wastewater discharge permit or waiver issued pursuant to this division. Any discharger notified of the suspension of the city wastewater treatment service, the water supply service, and/or the discharger's wastewater discharge permit or waiver shall within a period of time, as determined by the authority, cease all discharges. In the event of failure of the discharger to comply voluntarily with the suspension order within the specified time, the city shall notify the department of environmental quality and commence judicial proceeding immediately hereafter to compel the discharger's compliance with such order. The city shall reinstate the wastewater discharge permit or waiver and/or the wastewater treatment service and terminate judicial proceeding upon proof by the discharger of the elimination of the noncomplying discharge or collections creating the threat as set forth in this section.
