§ 34-33. Charges imposed upon responsible party.

  • When the city fire department or other personnel respond in connection with a hazardous materials release or incident, actual costs in excess of $200.00 incurred by the city responding to such hazardous materials release or incident (other than the cost of on-duty personnel), shall be imposed upon the responsible party, including, but not limited to, the costs incurred by the city for the elimination abatement, clean-up and restoration of the affected area or hazard, (not including on-duty personnel), which costs in excess of $200.00 shall include, but not be limited to, the following: actual labor costs, costs of equipment operation, costs of materials used, and the cost of any contract labor or materials incurred by the city.
